Abstract:
Each of the participants in the traffic knows what is driving under the influence of alcohol. A large number of those who enjoy psychoactive substances, and the drivers know what driving is under the influence of psychoactive substances. A small number of those who are drivers of any category, who use it on a daily basis at the doctor's recommendation of certain drugs, and that they know what the abuse of drugs means in traffic. The danger of misuse of drugs in driving is significantly higher when a traffic accident occurs due to such driving under the influence of drugs. In this paper, we pointed out the importance of the investigation of a traffic accident, first of all from the criminal aspect, when one of the participants in a traffic accident operated a vehicle under the influence of drugs. The solutions from the Law on Traffic Safety that exist in the Republic of Serbia can be of use to the officials of the police and judiciary of the Republika Srpska, as well as Bosnia and Herzegovina. These solutions are important for each local community or its competent authorities.
